terms of service

1. acceptance of terms

by accessing and using blackopscloud, you accept and agree to be bound by these terms, if you do not agree, do not use the service, you must be at least 18 years of age to use this service

2. service description

blackopscloud provides virtual private server (vps) infrastructure on a rental basis, we offer dedicated compute resources including cpu, ram, storage, and networking with root access, servers run ubuntu 22.04 and are provisioned automatically upon confirmed payment

3. accounts

you are responsible for maintaining the security of your account credentials, api keys, and server root passwords, you accept responsibility for all activity under your account, do not share your api keys, if you believe your account has been compromised, contact us immediately

4. payment

all payments are made via cryptocurrency through our payment processor (nowpayments), payments are final and non-refundable once confirmed on-chain, server rental periods begin upon successful vm provisioning, we do not store or process fiat currency

5. acceptable use

you may use our servers for any lawful purpose, the following activities are strictly prohibited and will result in immediate termination without warning or refund

• any illegal activity under applicable law, including but not limited to fraud, identity theft, money laundering, or trafficking
• child sexual abuse material (csam) or any content that exploits minors in any way
• launching attacks against other systems (ddos, brute force, port scanning, exploitation)
• sending spam, phishing emails, or bulk unsolicited messages
• distributing malware, ransomware, botnets, or command-and-control infrastructure
• hosting or distributing pirated content or intellectual property you do not own
• cryptocurrency mining without explicit authorization
• terrorist content, incitement to violence, or threats
• any activity that could expose blackopscloud to legal liability

we actively monitor for abuse signals and reserve the right to immediately suspend or terminate any account suspected of prohibited activity, servers involved in violations will be destroyed without notice and without refund, no exceptions

6. zero tolerance and law enforcement cooperation

blackopscloud maintains a zero tolerance policy for illegal activity, we will cooperate fully with law enforcement agencies and comply with valid legal requests, subpoenas, and court orders, if we have reasonable grounds to believe that your use of our service involves illegal activity, we may immediately terminate your account and destroy your servers, preserve and disclose relevant account information and logs to law enforcement, and report suspected criminal activity to the appropriate authorities

by using this service you acknowledge that privacy is not a shield for illegal conduct, we value your privacy for legitimate use, we will not protect you from the consequences of criminal activity

7. server management

you have full root access to your server, you are solely responsible for securing, configuring, and maintaining your server environment, we are not responsible for data loss, security breaches, or downtime resulting from your configuration choices

8. api usage

api access is provided via boc_ prefixed api keys, you may create up to 5 active api keys per account, api keys grant full access to your account's resources, treat them like passwords, we are not responsible for actions taken via compromised api keys

9. uptime and availability

we make reasonable efforts to maintain service availability but do not guarantee 100% uptime, scheduled maintenance will be communicated when possible, we are not liable for downtime caused by factors outside our control including network issues, hardware failures, or force majeure events

10. data and backups

you are responsible for backing up your own data, server destruction is permanent and irreversible, we do not maintain backups of customer data, when a server is destroyed, all data on it is permanently deleted

11. limitation of liability

blackopscloud is provided "as is" without warranties of any kind, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the service

12. termination

we may terminate or suspend your access at any time for violations of these terms, you may terminate your account at any time by destroying all active servers, no refunds will be issued for unused rental time upon termination

13. modifications

we may update these terms at any time, continued use of the service after changes constitutes acceptance of the new terms, material changes will be communicated via the website
